Terms and Conditions of Service

Welcome to The Five Dollar Bill Helper! Five Dollar Bill Helper, LLC (referred to in this policy as “Five Dollar Bill Helper”) has adopted the following Terms of Service which govern your relationship with Five Dollar Bill Helper and provide you with important information about your legal rights (“The Terms”). These Terms explain the rules you need to follow and the terms and conditions which govern your use when you visit our application and any affiliated web pages (“App”), and any other services Five Dollar Bill Helper might offer (together with App, “Services”).
 

The Services

Five Dollar Bill Helper is a budgeting application specifically intended to help Users learn how to manage a budget. The App provides tools for tracking income and expenditures via manual input and synchronization with users’ accounts.
 

Users and Subscriptions

“Users” of the App include persons who have registered for a Five Dollar Bill Helper subscription (“Subscription”). 
 

Eligibility and Subscription Information

You must be 14 years of age or older to subscribe. 
If you are under 18 years of age, you must obtain consent from a parent or guardian before subscribing. You will be asked to provide an email address for a parent or guardian during registration. The parent or guardian must consent to these Terms before you can continue with registration. 
By subscribing or using Five Dollar Bill Helper’s Services, you represent and warrant that you are either at least 18 years old, or are at least 14 years old and have received consent from your parent or guardian to enter into these Terms. When you subscribe, the information you provide needs to be true and accurate. Do not provide fake or false information, do not provide information that violates someone else’s rights, and do not impersonate someone else. Five Dollar Bill Helper may ask for proof of your age or identity at any time in order to verify your Subscription information and Five Dollar Bill Helper may terminate or suspend your Subscription if you violate this rule or if it is not possible to verify your age or identity. If your Subscription has been terminated by Five Dollar Bill Helper, you are no longer eligible to be a User.
 

Username and Password

Your email address will be used as your username. If you subscribe as a student using an email address given to you by your school, college, or university, your email address will be re-authenticated every 3 to 6 months to confirm eligibility for a free Subscription. 
 You will also be asked to pick a password to protect your Subscription information. Together this information is used to access the Services. It is your responsibility to keep your login information confidential; you are responsible for any and all activity conducted by anyone logged in under your Subscription, whether or not you authorized said activity.
 

Subscription and Fees

If you are a student at a secondary school or post-secondary school in the United States, you will not be charged for your Subscription. If you continue to use the App when you are no longer enrolled in a secondary or post-secondary school, you will be charged a monthly fee for your Subscription.
Subscriptions may be purchased on a month-to-month basis, or as a pre-paid 12-month Subscription. You are responsible for paying any amounts due for your Subscription. By subscribing to Five Dollar Bill Helper, you represent and warrant that the billing information you have provided is accurate. When you purchase a Subscription on Five Dollar Bill Helper, you represent and warrant that you are authorized to make the purchase and to use the payment method and billing information you provided. You further agree that Five Dollar Bill Helper may charge your payment method the amount due at the time you subscribe, and then automatically on a monthly basis for the duration of your Subscription. Five Dollar Bill Helper is not responsible for any additional fees you may be charged by your financial institution. Failure to pay as promised may result in suspension or termination of your Subscription, or any other action Five Dollar Bill Helper deems necessary. Five Dollar Bill Helper may, in its discretion, make changes to the Subscription(s) it offers, the privileges and features available to Users, as well as the rates associated with a Subscription at any time.
 

Referral System and Tokens

For every paid Subscription you refer, you will receive a Five Dollar Bill Helper token (“Token”) that awards you 1 month of Subscription for free. Tokens may be used only for future months’ Subscriptions and may not be used to refund a previous month’s subscription.
If you are a student and you graduate before June of your graduation year, you will receive Tokens to retain free access to the Services through June of your graduation year.
 

Subscription Termination

Five Dollar Bill Helper may, in its discretion, terminate or suspend the Subscription of any User at any time for any reason, with or without notice. You have the right to terminate your Subscription at any time, with notice to Five Dollar Bill Helper. You can terminate your Subscription by contacting Five Dollar Bill Helper. After your Subscription is terminated, you will be charged for and have access to the Services through the end of the last month of your Subscription. After the end of the month, you will no longer have access to any of the features of the Services that require a Subscription. Five Dollar Bill Helper may change, suspend, or discontinue offering the Services at any time. Any suspension or discontinuation in the Services may mean that that your Subscription may not be available to you or to other Members.
 

Privacy

The privacy and security of your data and the personally identifiable information are important to Five Dollar Bill Helper. Five Dollar Bill Helper’s Privacy Policy explains what data it collects from you and how that data is used. By using Five Dollar Bill Helper’s Services, you agree that Five Dollar Bill Helper may use such data in accordance with its privacy policies.
 

Intellectual Property Rights

All aspects of the App and Five Dollar Bill Helper’s Services are owned or controlled by Five Dollar Bill Helper. This includes, but is not limited to, all text, graphics, photographs, logos, and other imagery, videos, user interfaces, trademarks, computer code, and other content (collectively, “App Assets”). This also includes the design, structure, coordination, arrangement, expression, and the “look and feel” of App Assets. App Assets are protected by copyright, trademarks, trade dress, trade secret, and other intellectual property rights. You may not use, reproduce, copy, modify, republish, perform, display, disassemble, reverse engineer, translate, or distribute App Assets in any way for or to any person, computer, server, website, or other entity for any Commercial Purpose without Five Dollar Bill Helper’s express written permission. 
 

Limitation of Liability

Indemnification

If Five Dollar Bill Helper is sued or otherwise subject to liability because of your actions, you agree to defend Five Dollar Bill Helper against that liability. You agree to indemnify, defend, and hold harmless Five Dollar Bill Helper, its employees, officers, directors, agents, and affiliates from and against all costs, expenses, damages, judgments, and liabilities (including reasonable attorneys’ fees) resulting from allegations, threats, claims, suits, or other proceedings brought by third parties related to your use or misuse of the Services, including but not limited to any breach of these Terms, or violation of any federal, state, or local law.
 

Limitation of Liability & Warranty Disclaimer

You agree that the services are provided on an “as is” and “as available” basis. Five Dollar Bill Helper (including its employees, officers, directors, agents, and affiliates) disclaims any warranty of any kind, express or implied, with respect to your use of the Services. Five Dollar Bill Helper make no guarantees regarding the availability of the services, the security of the services at any particular time or from any particular location, the correction of any defects or errors, existence of any viruses or other harmful materials, or any other guarantees.
You agree that Five Dollar Bill Helper (including its employees, officers, directors, agents, and affiliates) shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, reputation, use, data, or other intangible losses, resulting from: (i) the access to, use, or the inability to access or use the Services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the Services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Services; or (vi) any other matter relating to the Services.

As you use Five Dollar Bill Helper’s Services, there may be links, ads, or other ways for you to visit other websites not owned or controlled by Five Dollar Bill Helper. When you access third party websites, you do so at your own risk. Five Dollar Bill Helper cannot and does not make any representations or warranties about other websites or services.
 

Third Party Services

The Services may permit you to link to other websites, or use other services or resources on the Internet in conjunction with Five Dollar Bill Helper’s Service (“Third Party Services”), and Third Party Services may contain links to the Services. When you access Third Party Services, you do so at your own risk. Third Party Services are not under Five Dollar Bill Helper’s control, and you acknowledge that Five Dollar Bill Helper is not responsible or liable for the content, functions, accuracy, legality, appropriateness, or any other aspect of such Third Party Services. You further acknowledge and agree that Five Dollar Bill Helper shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such Third Party Service.
 

General Provisions

Changes to Terms

Five Dollar Bill Helper may revise these Terms from time to time. The changes will not be retroactive, and the most current version of the Terms will govern the use of Five Dollar Bill Helper’s Service. Five Dollar Bill Helper will notify you of material revisions via a notification on the Site or an email to the email address associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
 

Binding Arbitration

You and Five Dollar Bill Helper agree that any dispute arising out of or relating to these Terms or your use of our Services will be settled through binding arbitration, conducted by the American Arbitration Association (AAA) and in accordance with their Commercial Arbitration Rules. Your responsibility to pay any filing, administrative, or arbitrator fees will be solely as set forth in the AAA rules. To the extent permitted under AAA rules, the arbitrator may award costs, fees, and expenses, including reasonable attorneys’ fees, to the prevailing party. A decision reached by arbitration will be final and binding and may be entered as a judgment by any court having jurisdiction. You understand that there is no judge or jury in arbitration, and that other procedural rights such as discovery and appeal are not available in an arbitration. You and Five Dollar Bill Helper each knowingly and voluntarily agree to waive your respective rights to a trial by judge or jury and to have your case heard in a court of law. Disputes will be settled on an individual basis. You and Five Dollar Bill Helper each knowingly and voluntarily agree to waive the right to bring or participate in a class, collective, consolidated, or representative action or arbitration. Notwithstanding this clause, each party may seek injunctive or other equitable relief in a court of competent jurisdiction in Iredell County to protect the party’s intellectual property rights pending completion of the arbitration.
 

Governing Law

These Terms are governed by the laws of the state of North Carolina and the laws of the United States of America, regardless of where you are located in the world. Any dispute subject to Binding Arbitration will take place in Iredell County, North Carolina. For any other judicial action that may arise between you and Five Dollar Bill Helper, or for judicial action to which the Binding Arbitration clause is found not to apply, both you and Five Dollar Bill Helper agree to submit to the venue and personal jurisdiction of the state and federal courts located in Iredell County, North Carolina.
 

No Waiver

Any failure by Five Dollar Bill Helper to enforce any right or provision of these Terms does not constitute a waiver of that right or provision and will not limit its right to act or enforce these Terms against subsequent or similar breaches.
 

Severability

If any part of these Terms is deemed invalid, unenforceable, or illegal, that part which is unenforceable is severed from the Terms, and will have no impact on the enforceability of the remainder of these Terms.

Entire Agreement

These Terms constitute the entire agreement between Five Dollar Bill Helper and Members in relation to its subject matter and supersede all previous agreements, representations, and understandings.

Apple Subscription Terms:
Payment will be charged to iTunes Account at confirmation of purchase.
Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal.
Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.

Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.



5 dollar offers Basic and Gold plans: 
The basic plan costs $4.99 per month and is billed on a recurring basis. The first month is free if you select the basic package.

The cost of the gold plan is $49.99 per year. If you choose this plan, the first month is free.
